The Truth about Creekside Apartments

Allegations have been made that the city unlawfully closed down Creekside apartments in 2022 and that it faces a $30 million dollar court judgement against it. This is false. What are the facts?

  • Despite being threatened with a lawsuit in September of 2023, no lawsuit has been filed against the city.
  • The investigation into Creekside Apartments began due to resident complaints to the city in the spring of 2022.
  • The apartment management voluntarily permitted city staff to inspect the apartment over the summer.

  • Creekside ownership admitted the conditions were unacceptable in December of 2022 and entered into an agreement with the city to voluntarily close the apartments. (LINK)
  • In September of 2023, Creekside ownership pulled out of the agreement with the city and asserted that they had been defrauded by the city, despite publicly acknowledging that the conditions at the apartment were unacceptable.
  • Political operative Wayne Dolcefino produced a series of propaganda videos asserting the closure of this known slum was a conspiracy theory. Creekside ownership then retained Mr. Dolcefino’s son, an associate at the Buzbee law firm, as their legal counsel. Prior to the involvement of the Dolcefinos, prior legal counsel for ownership consistently acknowledged the conditions as indefensible. 

Creekside Apartments were lawfully closed to protect the living conditions of residents. The city worked with a local charity to provide relocation assistance for the residents. The community knows that this property was in disrepair and knows that action was required.
